Overview

Welcome to Zipline Golf! The terms “Zipline,” “we,” “us,” and “our” refer to Zipline Golf, LLC. We operate this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our storefront is powered by Shopify.

These Terms of Service (“Terms”) describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Access and Account

You represent that you are at least the age of majority in your state or province of residence, and you consent to allow your minor dependents to use the Services on devices you own or manage. You may be asked to provide information (e.g., name, email, billing and shipping details, payment information). You represent that all information you provide is accurate, current, and complete and that you have the right to provide it. You’re responsible for keeping your account credentials secure and for all activity under your account. You may not transfer or sell your account.

2. Our Products

We strive to display our products accurately, but colors and appearance can vary by device and settings. We do not warrant that product appearance, quality, or features will meet your expectations. Product descriptions, availability, and pricing may change without notice; we may discontinue products or limit quantities to any person or region at our discretion.

3. Orders

Placing an order is an offer to buy. We may accept, reject, or cancel any order at our sole discretion (e.g., for availability, pricing errors, fraud concerns). An order is accepted only when we confirm acceptance and process payment. Review your order carefully; we may be unable to honor cancellation requests after acceptance. If an order is not accepted or is changed/canceled, we’ll attempt to contact you using the information provided at checkout. Purchases are subject to our Refund Policy. You represent that your purchases are for personal or household use, not for resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change at any time without notice. The price charged is the price in effect at the time of purchase and appears in your order confirmation. Unless stated otherwise, prices exclude taxes, shipping, handling, and any customs/import duties. Promotions may have additional terms; if there’s a conflict, the promotion terms govern. You agree to provide current, complete purchase and payment information and to promptly update it. You represent that you’re authorized to use the payment method and that all charges will be honored and paid, including applicable taxes and fees.

5. Shipping and Delivery

Delivery times are estimates only and not guaranteed. We are not responsible for carrier delays, customs processing, or events outside our control. Title and risk of loss pass to you when we deliver products to the carrier.

6. Intellectual Property

The Services and all related content (including trademarks, text, images, graphics, video, audio, and their selection and arrangement) are owned by Zipline, its affiliates, or licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. Except as permitted by law or by our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly perform or display, republish, download, store, or transmit any material from the Services. “Zipline Golf” names and logos are trademarks of Zipline or its affiliates; other names and logos are trademarks of their respective owners.

7. Optional Tools

We may provide access to third-party tools we do not control. You acknowledge these tools are provided “as is” and “as available” without warranties or endorsements, and we have no liability arising from your use. Your use of such tools is at your own discretion and subject to the providers’ terms.

8. Third-Party Links

The Services may contain links to third-party sites or content. We are not responsible for examining or evaluating such content and assume no liability for any third-party materials, websites, products, or services. Review third-party policies before engaging in any transaction with them.

9. Relationship with Shopify

Our store is hosted on Shopify, which enables us to provide the Services. All sales are made directly between you and Zipline Golf, LLC. Shopify is not responsible for any sales, products, warranties, or customer support relating to your transactions with us. You expressly release Shopify and its affiliates from claims arising from or related to your purchases from Zipline.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, Shopify also processes certain personal information to operate and improve the platform; see Shopify’s privacy materials for more details. By using the Services, you consent to our and Shopify’s processing of your information as described. For additional details, please review our Privacy Policy.

11. Feedback

If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display the Feedback for any lawful purpose. You represent that you own or control the rights to your Feedback and that it complies with these Terms. We may monitor, edit, or remove Feedback in our discretion. You agree not to submit unlawful, infringing, misleading, or harmful content, and not to misrepresent your identity or compensation.

12. Errors and Corrections

Occasionally the Services may contain typographical errors or inaccuracies (e.g., descriptions, pricing, promotions, shipping charges, availability). We may correct errors or update information, or cancel orders affected by such issues, at any time without prior notice (including after you submit your order).

13. Prohibited Uses

You may use the Services only for lawful purposes. You may not, directly or indirectly: (a) violate any law or third-party rights; (b) infringe intellectual property; (c) harass, defame, or abuse others; (d) transmit malware or harmful code; (e) send unsolicited or deceptive communications; (f) attempt to gain unauthorized access to the Services or related systems; (g) scrape, crawl, or collect others’ personal information; (h) interfere with security features; or (i) engage in conduct that, in our judgment, harms Zipline, Shopify, other users, or exposes them to liability. We may suspend or terminate access for violations.

14. Termination

We may suspend or terminate the Services or your access at any time, with or without notice. You remain liable for all amounts due up to the termination date. Provisions that by their nature should survive (e.g., Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law) will survive termination.

15. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY ZIPLINE IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers, so the above may not apply to you to the extent prohibited by law.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZIPLINE GOLF, LLC OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS (OR SHOPIFY AND ITS AFFILIATES) BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO ZIPLINE FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 6 MONTHS PRECEDING THE CLAIM. Some jurisdictions limit liability caps; the foregoing applies to the maximum extent permitted.

17. Indemnification

You agree to indemnify, defend, and hold harmless Zipline, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these Terms or referenced policies, (b) your violation of law or third-party rights, or (c) your use of the Services.

18. Severability

If any provision of these Terms is unlawful, void, or unenforceable, that provision is enforced to the maximum extent permitted and the remainder remains in full force.

19. Waiver; Entire Agreement

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and Zipline regarding the Services and supersede prior agreements.

20. Assignment

You may not assign or transfer these Terms or any rights or obligations without our prior written consent. We may assign or transfer these Terms without restriction.

21. Governing Law; Venue

These Terms and any disputes related to the Services are governed by the laws of the State of New York, without regard to conflict-of-laws rules. You and Zipline consent to the exclusive jurisdiction and venue of the state or federal courts located in Erie County, New York.

22. Headings

Headings are for convenience only and do not affect interpretation.

23. Changes to These Terms

You can review the current version of these Terms at any time on this page. We may update these Terms by posting a revised version with an updated “Last updated” date. Material changes will be communicated as required by law. Your continued use of the Services after changes are posted constitutes acceptance.
